A Civil Action Revisited
In his book, A Civil Action, Jonathan Harr tells the story of a prominent case litigated in the 1980’s. In one of the most compelling legal dramas ever written, he follows the attorneys for the plaintiffs throughout the litigation, even attending the most private and sensitive strategy meetings where settlement decisions were made. The popularity of the book led to a movie by the same name starring John Travolta.
Winning the Litigation Money War dedicates an entire chapter to the case chronicled in A Civil Action, using the ICBM methodology to evaluate the settlement decisions made by the plaintiffs’ attorneys and their litigation strategy. The ICBM shows how misguided their settlement decisions were and how ill-conceived their litigation strategy was using only the information available to them at the time.
In a later chapter in Winning the Litigation Money War, the first settlement conference in A Civil Action is reinvented to illustrate the use of the ICBM SPREADSHEET. This reinvented settlement conference shows how the ICBM SPREADSHEET allows both plaintiffs’ and defendants’ attorneys to quickly and easily evaluate settlement offers as settlement dynamics change during the conference.
